BRP RENAUD has been assisting insurance companies on insurance contract law and insurance supervisory law for many years. A particular focus of our work is the representation of insurance companies in legal proceedings. For matters that go beyond insurance law, we draw on BRP RENAUD’s legal expertise in the relevant area of law.

The insurance industry is subject to overregulation; constantly increasing, often unclear, sustainability requirements, and high compliance pressure. Online sales formats and new business models are resulting in far-reaching changes. Against this backdrop, our goal is to design functioning legal solution strategies for the players in the insurance industry.

THE INSURANCE PRACTICE GROUP ADVISES YOU ON THE FOLLOWING MATTERS, E.G.:

Insurance contract law: We advise you on claims and other contractual issues and disputes. We represent your interests nationwide in both out-of-court and contentious proceedings. We represent more than a hundred insurance companies every year. It is very important to us to be able to meet all of our clients’ needs and that it is very easy and uncomplicated for your claim handlers to contact us. Our effective, independent working methods reduce your workload in connection with legal disputes.

Insurance supervisory law and insurance company law: Our practice group advises you on corporate law structuring as well as on shareholdings and spin-offs. We provide you with comprehensive advice on insurance supervisory law issues and represent you before the German Federal Financial Supervisory Authority (BaFin) and in court.

D&O insurance: The courts increasingly have to deal with the liability of management board members, managing directors and managers. Our attorneys-at-law have experience both in the defense against claims for damages against the insured and in coverage proceedings within the scope of D&O insurance.

Insurer compliance: Compliance requirements are becoming increasingly extensive and complex. We work with your enterprise to design a robust, tailor-made compliance management system that meets the requirements of insurance supervisory law as well as the general compliance requirements governing commercial enterprises.

Asset management and funds: Our clients from the insurance industry benefit from BRP RENAUD’s legal expertise in capital markets law, securities law, and banking law. The Insurance Practice Group works closely with the Banking and Capital Markets Practice Group of our firm.

Data protection and IT law: We also advise insurance companies on IT and data protection law issues. We assist you with the drafting of IT contracts, particularly in the area of outsourcing, and in reviewing your data protection organization. We help implement processes to guarantee the rights of data subjects under data protection law and to take the necessary measures in the event of a data protection breach. If a claim is made against you for data protection violations in accordance with Art. 82 GDPR, we will advise and assist you in the relevant proceedings.

Intellectual property law: We take care of the registration of trademarks for insurance products and insurance companies, trademark administration, and trademark collision monitoring through to the complete outsourcing of this area. We represent you nationwide in all trademark disputes before the courts specifically responsible for trademark disputes and also out of court. In addition, we represent you before the competent trademark offices, DPMA, EUIPO and WIPO.

Competition law: We also represent you in competition law matters since we have many years of experience in defending our clients against unjustified warnings and injunctions from consumer associations.

Social security law: We offer specialized advice on status queries from the sales force in connection with social security law (dependent employment or self-employment) as well as in the context of social security audits. We also represent you vis-à-vis the social insurance institutions and before the social courts.
